Course content
|
1. Introduction; meeting the question of Legal Protection of Health; information about conditions of course study 2. The basic principles and legal concepts of Legal Protection of Health 3. Internationally-legal grounds of the Legal Protection of Health; the basic principles resulting from The European Convention on Human Rights and Biomedicine; the Legal Protection of Health in the Czech Constitution System ? above all, the article 31 of the Charter of Fundamental rights. 4. The regulatory arrangement of the Legal Protection of Health - Public Health Act, General health protection law, Smoke-free law, ect. 5. The Czech Health Insurance System; competence of healthcare providers; the doctor's free choice. 6. Liability for health damage according to the Civil Code; protection of personality according to article 11 of the Civil Code; legal regulations of protection of personality according to the new Civil Code bill. 7. Health protection according to the Labour Code - protection of occupational health and safety; liability in labour-law relations. 8. Health protection according to the Penal Law and the Violation Law; offence against the life and the health. 9. Protection of patients' rights in health care. Health care in International law and Czech system of law. 10. Legal regulations of the transplantation acts and the tissue demand; the assisted reproductive technology; the abortion; the sterilization and the castration in the Czech Republic. 11. Health documentation. 12. Written test.

Students are able to: - explain the basic principles and legal concepts of Legal Protection of Health, - describe the Czech health care system, - explain and compare the basic principles of liability for health damage and protection of personality according to the Civil Code, the Labor Code, the Penal Law and the Violation Law, - explain the legal regulations of the transplantation acts and the tissue demand, the assisted reproductive technology, the abortion, the sterilization and the castration in the Czech Repulic, - evaluate patients' rights in the Czech health care system. |
